My Client who is exporting Software Services furnished a Bond in Sep.,2017 to export without payment of IGST. In May,2018, he submitted an LUT online for the same purpose. Whether he is liable to pay IGST on the Export Invoices issued in April,2018

Answer

LUT relating to export in previous months cannot be filed with retrospective effect. You can file LUT online and ARN No. will be provided online followed by LUT No. You can start export with generation of ARN No.

For the Previous months Show cause notice will be issued but you can argue it on the ground of procedural lapses.

At present you can't do any thing for the export done without LUT, Wait for the Show cause notice then decide about the reply to be given. (reply dt. 25/05/2018)
